CAN-SPAM

In the vast digital landscape, email marketing remains a powerful tool for businesses to connect with their audience and drive growth. However, the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003 (yes, that's really what it stands for!), better known as CAN-SPAM, sets the rules of the road for commercial emails.

While the name might conjure images of shady spammers peddling questionable products, CAN-SPAM applies to a wide range of email marketing activities, even for legitimate businesses.

What is CAN-SPAM?

CAN-SPAM is a US federal law that establishes requirements for commercial emails, including those promoting a commercial product or service, or a company or organization. It doesn't just apply to bulk emails; it covers any email with a primary purpose of commercial advertising or promotion.

Key provisions of CAN-SPAM:

  • Don't use false or misleading header information: Your "From," "To," and "Reply-To" information must be accurate and identify the person or business who initiated the message.

  • Don't use deceptive subject lines: The subject line must accurately reflect the content of the message.

  • Identify the message as an ad: You must clearly and conspicuously disclose that the message is an advertisement.

  • Tell recipients where you're located: Your message must include your valid physical postal address.

  • Provide an opt-out mechanism: You must provide a clear and conspicuous way for recipients to opt out of receiving future emails from you.

  • Honor opt-out requests promptly: You must honor opt-out requests within 10 business days.

  • Monitor what others are doing on your behalf: Even if you hire another company to handle your email marketing, you're still responsible for complying with CAN-SPAM.

Why is CAN-SPAM important?

CAN-SPAM is designed to protect consumers from unwanted and deceptive commercial emails. It also helps legitimate businesses maintain a positive reputation and avoid legal trouble. Non-compliance can lead to:

  • Fines and penalties: Each separate email in violation of CAN-SPAM can result in a penalty of up to $50,120.

  • Reputational damage: Spam complaints can harm your sender reputation and deliverability rates.

  • Legal challenges: The Federal Trade Commission (FTC) and state attorneys general can take legal action against violators.

How can businesses comply with CAN-SPAM?

  • Be transparent and honest: Use clear and accurate header information, subject lines, and sender identification.

  • Provide an easy opt-out: Make it simple for recipients to unsubscribe from your emails.

  • Respect opt-out requests: Honor opt-out requests promptly and don't send further emails to those who have opted out.

  • Monitor your email marketing campaigns: Keep track of your email metrics and address any spam complaints promptly.
